Notary words
The Spanish Notary performs an essential role in preventive legal security, intervening in a wide range of legal acts and transactions, either because the law requires their formalization in a public deed—as is the case, among others, with the incorporation of companies—or because the legal system grants notarial documents particularly significant legal effects. This role is based on the Notary’s impartiality, high level of legal expertise, and status as a public official.
Accordingly, the notarial document enjoys full legal effectiveness: it constitutes an enforceable instrument, provides conclusive evidence of the date and content of the act executed, guarantees the identity, legal capacity, and free will of the parties involved, and offers maximum legal certainty in legal transactions. For this reason, notarial documents are eligible for registration in the corresponding Public Registers, such as the Land Registry or the Commercial Registry, depending on the nature of the documented act.
